Terms of Use​

These terms and conditions (the “Agreement”) govern the quote for funeral, memorial, and cremation services (the “Services”) provided by Just A Simple Cremation (ABN 57 635 013 286), (“we,” “us,” or “our”) and the person accepting the quote (“you” or “your”). The Agreement includes the terms outlined here and any related documents, including the quote you received online, via email, or by post (the “Quote”). By accepting the Quote, you agree to the following terms.

  1. Services and Variations

By accepting this Agreement, you confirm your request for Services within the geographic area specified in the Quote. You accept this Agreement by:

  • (a) Sending us an email accepting the Quote;
  • (b) Confirming acceptance by telephone; or
  • (c) Making part or full payment of the Price (as detailed in the Quote).

Any changes to the Agreement or the Price must be made in writing and agreed upon by both parties. We may, at our discretion, obtain your credit information from credit reporting bodies prior to providing our Services. If we receive any credit information about you from a third party, we will protect it in accordance with our Credit Information Policy.

  1. No Conflict

By accepting this Agreement, you confirm that you are authorized to request the Services and are not aware of any family members or other relevant parties who would oppose the Services. You agree to provide all documents and information reasonably requested by us to facilitate the provision of the Services.

  1. Service Partners

In exchange for your payment of the Price, we agree to provide the Services to you. These Services may be delivered by us directly or through our subcontractors, which may include providers such as transfer providers, crematoriums, mortuaries, hospitals, florists, government registries, venues, and caterers (collectively, “Service Partners”).

  1. Personal Effects

Before we or our Service Partners collect or take delivery of the Deceased, you must remove any personal effects such as clothing, jewelry, items, or other personal belongings. Unless otherwise confirmed by us in writing, any personal effects provided with the Deceased will be cremated.

  1. Payment

You agree to pay the Price (including any applicable GST) for the Services, either online or via telephone through our third-party payment processor, following receipt of the Quote. If we send you an invoice, payment is due no later than 7 days after receipt unless otherwise agreed upon in writing. If payment is not made by the due date, we may, at our discretion:

  • Cease providing the Services after a 5-day grace period, and recover any reasonable costs of doing so;
  • Apply a late payment fee of up to 10% for any amount unpaid after 30 days;
  • Charge the unpaid amount directly to your nominated payment account, if we have your payment details on file, under direct debit authorization;
  • Record a default on your credit file.

We may offer payment plan options through third-party providers (“Payment Plan Provider”). You acknowledge and agree that:

  • The Payment Plan Provider is solely responsible for the payment plan;
  • You will need to accept the terms and conditions of the Payment Plan Provider;
  • The Payment Plan Provider may charge an additional fee on top of our fees;
  • The Payment Plan Provider may conduct a credit check on you and may refuse to provide a payment plan;
  • We are not liable for any loss, damage, or issues arising from the Payment Plan Provider or any issues with obtaining a payment plan.
  1. Privacy

We will handle any personal information you provide to us solely for the purpose of fulfilling our obligations under this Agreement, in accordance with applicable privacy laws and our privacy policy.

  1. Australian Consumer Law

Under Australian Consumer Law (ACL), you are entitled to certain rights, warranties, guarantees, and remedies related to the Services that cannot be excluded, restricted, or modified. Nothing in this Agreement excludes these Consumer Law Rights.

  1. Liability

To the maximum extent permitted by law, and subject to your Consumer Law Rights:

  • We will not be liable for any indirect or consequential loss.
  • Our total liability under this Agreement will be limited to the amount you have paid for the Services.
  1. Force Majeure

If the performance of the Services becomes impossible due to events outside of our control or the control of our Service Partners, we may cancel or suspend this Agreement or the part of it that cannot be performed.

  1. Survival

The clauses related to payment (Clause 5), privacy (Clause 6), and Australian Consumer Law (Clause 7) will survive the termination or expiry of this Agreement.

  1. Definitions
  • Deceased means the person who has passed away and for whom we will perform the Services.
  • Liability means any expense, cost, liability, loss, damage, claim, notice, entitlement, investigation, demand, proceeding, or judgment, whether arising under statute, contract, equity, tort (including negligence), indemnity, or otherwise, and whether present, unascertained, future, or contingent, and whether involving a third party or a party to this Agreement.
  • Services means the cremation and associated funeral services as specified in the Quote for the requested geographic area.
